Proceeds of crime investigations generally involve the identification, seizure/restraint, management, and disposition of property derived directly or indirectly from the commission of a criminal offence. The ultimate forfeiture of such property on conviction can represent a significant sanction against the accused by depriving them of those things and or benefits they have obtained through the commission of crimes. Considering the definition of proceeds of crime, almost any police investigation can result in its discovery and seizure, and is not limited to the work of specialized units.

This course will cover legal concepts and framework that govern and guide proceeds of crime investigations and help you develop a basic conceptual understanding of how to lawfully identify, deal with, and support the forfeiture of proceeds of crime.

When you have completed this course you will be able to:

  • Define proceeds of crime and differentiate it from offence-related property
  • Identify the provisions that provide for seizure, post-seizure reporting, restraint, management, and forfeiture of proceeds of crime
  • List the evidentiary requirements for successful prosecution of proceeds of crime offences (in addition to forfeiture like offence-related property)
  • Describe how offence-related property and proceeds of crime are similar in terms of management, forfeiture, etc.
  • Recall the different forfeiture options
